How the claim is funded
Of course, we always aim to win every claim and when we do, all costs and expenses are paid for by the Defendant. However, in the event that the claim is not successful, there are a number of ways your costs and expenses can be paid for, without you having to.

Many clients find that they have legal expense insurance already in place which will cover them from paying for legal charges when instructing a solicitor. Other ways of funding the claim include ‘No Win No Fee' agreements.

In either case, we guarantee that you will not be asked to pay for any costs or expenses incurred during the claim whether we win or lose, because when a claim is funded by legal expense insurance, then it is the insurance company who pays for the costs and expenses of the claim if you lose.

No Win No Fee - Conditional Fees
If we advise you that the most appropriate way of funding your case is to use a ‘No Win No Fee' agreement, then as your Solicitor, we agree not to charge you any costs if we lose, as we will have protected you by putting an insurance policy in place for you. However, under a ‘No Win No Fee' agreement, if we win, we are entitled to charge a success fee, which the Defendant will have to pay.

Health care treatment and treatment costs
Throughout the claim, we will be ensuring that you receive the best assessment by Consultants and the best private treatment for your particular needs from physiotherapy to chiropractic treatment, counselling or re-habilitation, or even surgery. The cost of this is funded under the agreements already in place and you don't need to pay for it.

Time Limits on making a claim
A claim for compensation should usually be made within 3 years of the date of the accident (although not always). If the accident occurred before the victim's 18th birthday, then they have until their 21st birthday to claim.

It is always advisable to take specialist legal advice from a solicitor as soon as possible after the accident.

What to do if an accident occurs
Get all the names and addresses of anybody else involved in the accident, any witnesses, or others who were there at the time.

Make sure you get treatment from your GP or from hospital for your injuries.

Try to get photos of the accident scene or any scars or bruises you have suffered.

Keep receipts of all expenses incurred as a result of the accident, so we can get these re-paid.

If you were involved in an Road Traffic Accident, and there are any injuries, notify the Police, get the other parties insurance and vehicle details and pass all of it on to us.
